Agreement to Terms

By accessing or using Eloquence ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

Eloquence is an AI-powered language learning application that provides personalized conversation practice, vocabulary exercises, and educational content for learning Spanish, French, Italian, and Portuguese. The service uses artificial intelligence to adapt to your learning level and preferences.

User Accounts

Registration

• You must create an account to use Eloquence
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to create an account

Account Security

You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access.

Subscription and Payment

Subscription Plan

Eloquence offers a simple subscription model:

• Free Trial: 14-day free trial with full access to Premium features.
• Premium Subscription ($4.99/month on web, $5.99/month in app): Full access to all AI features, voices, and learning modes, with a generous monthly usage budget.
• Top-Ups ($0.99): Optional one-time purchase to add 25% more usage if you exhaust your monthly budget. Unused top-up budget rolls over to the next month.

Usage Limits

To ensure fair access to high-quality AI services, the Premium subscription includes a monthly usage budget sufficient for regular daily practice. Heavy users may reach this limit and can choose to wait for the next billing cycle or purchase a Top-Up to continue using premium AI features. Basic app features remain available.

Billing

• iOS App: Subscriptions and top-ups purchased within the iOS app are billed through Apple's App Store and subject to Apple's terms.
• Website: Subscriptions purchased via our website are billed securely through Stripe.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Prices are subject to change with notice.

Cancellation & Refunds

• Apple IAP: Cancel via iOS Settings > Apple ID > Subscriptions. Refunds are handled exclusively by Apple.
• Web/Stripe: Cancel via the implementation settings portal on our website.
• Cancellation stops future billing but does not refund the current period. Access continues until the end of the billing cycle.

Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated tools to access the service without permission
• Share your account credentials with others
• Reverse engineer or attempt to extract source code
• Use the service to harass, abuse, or harm others
• Submit false or misleading information

Content and Intellectual Property

Our Content

All content, features, and functionality of Eloquence (including text, graphics, logos, AI models, software) are owned by Eloquence AI Learning and protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of content you create using the App. By using the service, you grant us a license to use your content solely to provide and improve the service.

AI-Generated Content

Content generated by AI during your learning sessions is provided for educational purposes. While we strive for accuracy, AI-generated content may contain errors and should not be relied upon as definitive.

Disclaimers and Limitations

Educational Purpose

Eloquence is an educational tool designed to supplement language learning. We do not guarantee specific learning outcomes or proficiency levels.

Service Availability & Third-Party Reliance

Eloquence relies on third-party AI providers (including Google, OpenAI, Groq, and xAI/Grok) to generate content. While we strive for high availability, temporary service interruptions may occur due to provider outages beyond our control. We are not liable for such outages but will work to restore service as quickly as possible. If you experience prolonged issues, please contact support for assistance.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELOQUENCE AI LEARNING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Third-Party Services

Eloquence uses third-party services including:

• Google Gemini AI for conversation generation
• OpenAI, Groq, and xAI (Grok) for additional AI features
• Google Cloud Platform for hosting and storage
• Firebase for authentication and database

Your use of these services is subject to their respective terms and privacy policies.

Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in behavior that we deem harmful to the service or other users. Upon termination, your right to use the App will immediately cease.

Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via the App or email. Continued use after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Eloquence AI Learning operates, without regard to conflict of law provisions.
